What is a Wrongful Death Case?

Wrongful death cases are divided into two categories- wrongful death of a minor child and wrongful death of an adult.  In a wrongful death case, the person who passed away is called the decedent.

Wrongful Death of a Minor Child- in this type of wrongful death case, the child’s parents can bring a claim against the responsible party for the death of their child.

Wrongful Death of an Adult- in this type of wrongful death case, the following people may bring a claim against the responsible party for the death of the adult:

  • The decedent’s grandchildren, if the decedent’s children are deceased
  • Any minors who were at least 50% dependent on the deceased for financial support
  • Any individual entitled to the decedent’s property according to California’s intestate succession laws

When Can You Take Legal Action?

In California, you are required to file a lawsuit within two years of the date that the wrongful death occurred.  However, if the wrongful death was caused by a government entity or anyone acting on behalf of a government entity, you are required to file a Claim for Damages within six months of the date of the wrongful death.
