Truck Accident Lawyer Los Angeles

With over eleven million trucks actively operating across the United States, commercial truck accidents can cause serious injuries and death due to their size, weight, and the large number of blind spots a truck driver is faced with.  Further, the imbalance between the weight of a commercial truck and the pedestrian, bicycle, motorcycle, or car that it hits can cause devastating injuries.  Commercial trucks generally weigh 20-30 times more than a standard automobile.

Truck accidents must be investigated thoroughly and with an attention to detail.  Additionally, a seasoned truck accident attorney will know how to investigate not only the truck driver, but the trucking company as well.  By investigating the trucking company, you can gain valuable insight and evidence into how the truck driver caused the accident and how the trucking company contributed to the driver’s actions.  The experienced truck accident attorneys at Eisenberg Law Group can guide you through the process of getting you the best medical care, gathering all of the essential evidence, and building the strongest possible case against the powerful trucking company that hurt you.

What are the Most Common Causes of Truck Accidents?

Commercial truck drivers are forced to drive long hours through intense traffic and difficult weather conditions, yet they are often fatigued, operating on minimal sleep, and need rest.  Unfortunately, however, truck drivers have an inherent financial incentive to complete their routes as quickly as possible.  Once a commercial truck driver completes his/her route and gets paid, he/she can pick up another load and start earning additional money.  Therefore, truck drivers are reluctant to take proper rest breaks and their employers do not monitor those rest breaks as they should.  As you can see, one of the most common causes of truck accidents is fatigue.

The primary factors causing truck accidents are the following:

  • Truck driver fatigue
  • Blind spots
  • Truck driver is in a rush to deliver the load or pick up a new load
  • Trucks cannot brake as quickly as other vehicles
  • Trucks cannot maneuver as quickly as other vehicles

When Can You Take Legal Action?

In California, you are required to file a lawsuit within two years of the date that the truck accident occurred.  However, if you were injured by a government entity or anyone acting on behalf of a government entity, you are required to file a Claim for Damages within six months of the date of the accident.

What Kind of Damages Can I Recover in a Truck Accident Case?

Under California law, if you have been injured in a truck accident you can recover two different categories of damages: Economic Damages and Non-Economic Damages.

Economic Damages include the following:

  • Property damage (damage to your vehicle and personal belongings)
  • Loss of earnings (money lost due to time off from work)
  • Medical bills and expenses (past and future)
  • Medication expenses (past and future)
  • Expenses for medical equipment such as a wheelchair, cane, or brace
  • Rental car expenses

Non-Economic Damages include the following:

  • Physical pain
  • Mental suffering
  • Loss of enjoyment of life
  • Anxiety
  • Inconvenience
  • Grief
  • Humiliation
  • Emotional distress

Under California law, if you have been injured in a truck accident, you are entitled to be compensated for each and every item of damage described above.  More importantly, you are entitled to recover both past and future non-economic damages.  At Eisenberg Law Group, we know how to maximize the value of each item of damage so that your recovery is as large as possible.

Don’t allow the insurance company to minimize your claim.  Make sure that you have an attorney that knows how to recover the maximum amount for each and every item of damage allowed under California law.

What Should I Do at the Scene of a Truck Accident?

In order to preserve critical evidence and prepare yourself to maximize your compensation after a truck accident, take the following steps:

  1. Make sure that everyone is ok.If anyone needs emergency medical attention, immediately call 9-1-1.
  2. Report the accident to the police and request that they prepare a Traffic Collision Report. Make sure to get the Traffic Collision Report number.
  3. Gather the information (names, driver’s licenses, insurance companies, insurance policy numbers, vehicle makes and models, and license plates) of all drivers and vehicles involved in the collision. Taking photographs of this information will work well.
  4. Find out the name, address, and phone number of the trucking company and the trucking company’s insurance company.
  5. Gather the names and contact information (phone numbers, addresses, e-mail addresses) of any and all witnesses to the accident.
  6. Take photographs of the scene of the collision, including where the vehicles ended up, damage to the vehicles, the nearest intersection, and traffic control signals.
  7. Take photographs of your injuries.
  8. Call our office for a FREE, no obligation consultation.

What Do I Need to Know About Commercial Trucking Insurance?

Because commercial trucks can cause such significant injuries, California law requires truck drivers to carry large insurance policies.

For commercial vehicles with a seating capacity of 7 or less, a minimum of $750,000 in insurance is required.

For commercial vehicles with a seating capacity of 8 to 15, $1,500,000 in insurance is required.

For commercial vehicles with a seating capacity of 16 or more, $5,000,000 in insurance is required.

If a commercial vehicle is an authorized for-hire motor carrier that transports regulated commodities, it must file a proof of public liability, which includes bodily injury insurance and property damage insurance.

For commercial vehicles weighing less than 10,000 pounds, they must carry at least $300,000 in liability insurance.

For commercial vehicles weighing 10,000 pounds or more, they must carry at least $750,000 (single limit) in liability insurance.

Frequently, however, commercial trucking companies have larger insurance policies to protect themselves in the event of a significant accident or injury.

An experienced truck accident attorney can help you navigate the complex web of commercial trucking insurance policies so that you obtain maximum recovery for your claim.  For example, the experienced truck accident attorneys at Eisenberg Law Group have helped their clients find multiple insurance policies on one tractor-trailer, one for the tractor and one on the trailer, thereby doubling the clients’ recovery.
